David A. Strauss

David Strauss is an experienced litigator, concentrating his practice on the representation of insurers in bad faith litigation, catastrophe/mass tort defense, insurance fraud claims and insurance coverage matters. He also has experience handling maritime and oilfield personal injury litigation and commercial disputes. David joined King, Krebs, & Jurgens in 1998 and now serves on the firm's management committee.

David's insurance practice is broad and varied. He has represented national insurers and their insureds (individual and commercial) in claims regarding: mass joinder and class actions related to insurance coverage, first party property damage and personal injury, third party property damage and personal injury, business interruption coverage, commercial general liability, condominium association and agent procurement issues.

David has handled every manner of first party and third party insurance fraud cases, including: arson, theft and organized personal injury fraud rings. His casualty practice emphasizes serious and catastrophic injury cases.

David also has experience representing oilfield service companies and their insurers in maritime and land well personal injury disputes in Louisiana and Texas. His representation includes disputes regarding the interpretation and application of Master Service Agreements between service companies and well operators and the negotiation of such Agreements.

David further provides representation and general advices to small businesses, particularly closely held retail enterprises.

Representative Matters

    • Representing national insurer in third party Chinese Drywall litigation initiated in Louisiana against insurer
    • Representing national insurer in every coverage lawsuit filed in Louisiana against the insurer by its insureds a result of Hurricane Gustav, including bad faith claims
    • Negotiated and created a framework for the first mass settlement of over 700 Hurricane Katrina insurance claims pending in the Eastern District for national insurer
    • Defending national insurer in mass joinder litigation pending in the Eastern District and involving hundreds of Hurricane Katrina bad faith claims for coverage under homeowners policies
    • Representing national insurer in project to recover monies improperly paid to insureds who made false claims of flood damage to hundreds of vehicles as a result of Hurricane Katrina
    • Negotiated protocol in consolidated federal Hurricane Katrina insurance litigation regarding the State of Louisiana Road Home program's review and consideration of settled insurance claims
    • Obtained insurance fraud verdict for large insurer following two-week trial regarding staged vessel accident involving claims of significant disabling injuries by four plaintiffs and affirmation of verdict on appeal to Louisiana Fourth Circuit
    • Obtained insurance fraud verdict for large insurer where plaintiffs were shown to have not been involved in auto accident
    • Obtained zero verdict for self-insured commercial entity in serious personal injury case involving plaintiff who underwent three separate surgeries following the accident and affirmation of the verdict on appeal to the Louisiana First Circuit
    • Obtained zero verdict for oil field service company in personal injury case involving claims of serious injury from H2S exposure at a well site and affirmation of verdict on appeal to the Louisiana First Circuit
    • Successfully defended insurance companies through trial in an array of property and personal injury cases, many involving claims of bad faith
    • Provide general advices to insurers on insurance fraud investigations
