David Strauss and Adam Massey obtain defense verdict for national insurer following 5-day jury trial

David Strauss and Adam Massey defended a national insurer and its insured in a casualty case involving both liability and medical causation issues in the Civil District Court for the Parish of Orleans.

The plaintiff (who was an attorney) claimed the insured negligently caused a vehicular accident at Lee Circle in New Orleans. The plaintiff subsequently alleged serious personal injury and underwent a multi-level cervical fusion. Strauss and Massey argued the plaintiff caused the accident, possibly with intent, that the accident did not cause the plaintiff to suffer any injury and that the plaintiff was not credible. After years of contentious litigation and a 5-day trial, the jury unanimously found in favor of the defendants on liability and avoided the need to reach the causation issues.
