King, Krebs & Jurgens attorney Len Brignac was quoted by Society for Human Resources Management editor Rebecca Hastings, SPHR, regarding the practice of progressive discipline in the workplace. Progressive discipline is more commonly known as the "three strikes, you're out" approach to amend employee behavior. 

According to Len, progressive discipline can minimize employee misunderstandings about the consequences for violating company rules, improve employee behavior, limit discrimination claims and make it easier to terminate poor performers. He also cites negatives that come along with the practice. "It can be more time consuming and requires strict adherence and complete and faithful documentation. It also limits the employer's discretion in those circumstances in which the employer may not want to impose mandated discipline."
